To Receive any Declarations of Interest and Notification of any Dispensations Granted

You are invited to declare any registerable and/or non-registerable interests in matters appearing on the agenda, and the nature of that interest.

 

You are also invited to disclose any dispensation in relation to any registerable and/or non-registerable interests that have been granted to you in respect of any matters appearing on the agenda.

Exclusion Resolution

The Committee will be requested to pass the following resolution:

 

Resolved that under Section 100A(4) of the Local Government Act 1972 (as amended) and having applied a public interest test as defined in Part 2 of Schedule 12A of the Act, the press and public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A to the Act.

Minutes:

It was agreed to pass the exclusion resolution.

RQ6/20

Appeal against refusal to allow advertising on Hackney Carriage Vehicle - Mr K

To consider an appeal against the decision not to permit advertising on the side and rear windows of a Licensed Hackney Carriage.

Minutes:

The Committee received a report which outlined the background to an appeal by Mr K against the decision of the Authority to refuse his request for advertisements to be placed on the side and rear windows of his Hackney Carriage Vehicle.  The Authority had refused the request as the proposed fashion of the advertisements did not comply with the Authority’s Hackney Carriage and Private Hire Licensing Policy.

 

Mr K attended a virtual meeting of the Committee.

 

A Licensing Officer presented the report to the Committee which included relevant information from the Hackney Carriage and Private Hire Licensing Policy in relation to signs, notices and advertisements.  The appeal form submitted by Mr K was also included. 

 

Mr K then addressed the Committee.

 

Following a summing up from the Licensing Officer and Mr K, both parties left the virtual meeting to enable consideration of the matter to be undertaken in private.

 

The options available to the Committee were:

 

·         Uphold the appeal and grant permission for the advertisements; or

·         Dismiss the appeal and refuse permission for the advertisements.

 

Resolved that Mr K’s appeal be dismissed and permission to display the advertisements refused.
