Minutes: Councillor M Thirlaway declared that he had engaged in email correspondence with one of the objectors. He clarified that this correspondence related to the process to be followed, rather than details of the application itself. The Applicant did not raise any concerns about this.

Application for a New Premises Licence - Somals, Mylord Crescent To consider representations made in relation to the Application for a New Premises Licence. Additional documents:
Minutes: The Sub-committee met to consider an application for the grant of a new Premises Licence in respect of Unit 10 Morgan Business Park, Mylord Crescent, NE12 5UJ.
The applicant, Mrs Rani Johal, sought permission for the supply of alcohol, off the Premises, between 12:00 hours and 03:30 hours every day. The Premises shall not be open to the public, the sale of alcohol shall be by way of delivery service only and therefore the consumption of alcohol will be off the Premises.
Following introductions the Sub-committee’s legal advisor outlined the procedure to be followed at the hearing.
Mr Callum, Licensing Officer, presented details of the application, the representations received and the options available to the Sub-committee. He responded to questions from Members of the Sub-committee.
Mrs Johal set out details of her representation in relation to the application and responded to questions from Members of the Sub-committee and Mr Callum.
Each of the parties to the hearing were given the opportunity of summing up their respective cases and the Sub-committee retired to make its decision in private.
All parties were invited to return to the meeting and the Chair announced the Sub-committee’s decision.
Resolved that the application for the grant of the Premises Licence in respect of Unit 10 Morgan Business Park, Mylord Crescent, NE12 5UJ be approved as follows:
Supply of alcohol (off premises only): 12:00 hours to 03:30 hours every day.
The following conditions are attached to the licence:-
1.
All sales of alcohol from the Premises will only be
by way of online or telephone order and by way of delivery to a
known address. 2.
The Licence Holder and his/her staff will ensure
that only employees and delivery drivers are permitted to enter or
remain on the Premises. The public shall not be permitted to attend
the Premises to purchase alcohol. No sales will be made to anyone
attending the Premises in person. 3.
All sales of alcohol must take place before 03:30
hours. The last delivery of alcohol from the Premises must be
completed by 04:00 hours. 4.
No alcohol will be delivered to any customer until
details of the customer, including his/her name, date of birth, the
address where alcohol is being delivered to, quantity, description
and price of the alcohol is entered into a register (electronic or
otherwise) that will be kept at the Premises at all times. The
register will be available for inspection by authorised officer of
the Licensing Authority (including Trading Standards Officers) or
representatives of Northumbria Police immediately on request made
in accordance with the Data Protection Act 2018/General Data
Protection Regulation (or any replacement legislation). 5.
