Minutes:

The Sub-Committee met to consider an application for a Review of a Premises Licence in respect of Danials Newsagents, 270 High Street, Wallsend, NE28 7RX.

The applicant, The Local Weights and Measures Authority put forward their case in support of their review application.  Representations were invited from responsible authorities and were received from Northumbria Police and The Director of Public Health.

The Licensing Officer presented his report to the Sub-Committee and the Sub-Committee also heard from the Applicant (The Local Weights and Measures Authority), the representative from Northumbria Police and the representative of the Director of Public Health.  All representatives answered any questions put to them by the Committee or the Premises Licence Holder.

The Sub-Committee also heard from the Premises Licence Holder to explain his position.

Each of the parties also had the opportunity to sum up their respective cases and the Sub-Committee retired to make its decision in private.

All parties were invited into the hearing and the Chair announced the Sub-Committee’s decision.

Resolved –   that the Premises Licence at Danials Newsagents, 270 High Street, Wallsend be suspended for a period of 3 months.

Reason for the Decision:

The Sub-Committee has grave concerns over the impact on the licensing objectives at this Premises and that this application came very close indeed to a full revocation, but a suspension on this occasion would be proportionate and a deterrent to the irresponsible trading described.
