The Sub-committee met to consider an application for the grant of a new Premises Licence in respect of King Kebab, 222 Whitley Road, Whitley Bay, NE26 2TA.

 

The applicant, SNKR Property Limited, sought to permit the premises to provide Late Night Refreshment (for consumption away from the premises) each day between 23:00 hours and 04:00 hours with the premises being open between 10:00 hours and 04:00 hours each day.

 

As the applicant was not in attendance nor represented at the hearing and the persons making representation were also not present the Sub-committee had to decide whether it was in the public interest to adjourn the hearing to allow the attendance of those parties or whether to continue with the hearing. The Sub-committee agreed that it was in the public interest to continue with the hearing.

 

The Sub-committee’s legal advisor outlined the procedure to be followed at the hearing.

 

Mr Callum, Licensing Officer, presented details of the application, the representations received and the options available to the Sub-committee.  He responded to questions from members of the Sub-committee and the Sub-committee’s legal advisor.

 

Mr Callum was given the opportunity to sum up the Licensing Authority’s case and the Sub-committee retired to make its decision in private.

 

Mr Callum was invited back into the hearing and the Chair announced the Sub-committee’s decision.

 

Resolved that the application be rejected.

 

Reasons for decision:

 

·       The location of the premises within the Cumulative Impact Area and the resident’s evidence of the problems associated with other similar licenced premises close by;

·       The quality of the application and the lack of detail provided on how the likely impact on the licensing objectives might be mitigated; and

·       The difficulty in finding sufficient suitable conditions which would address the above issues.
